Geographical Indication

Malaysia’s Geographical Indications Act 2022 (“the 2022 Act”) protects an indication that can identify any goods (wine and spirits, manufactured goods, handicrafts, food and agricultural products) as originating from a particular country, territory, region or locality, where there is a given quality, reputation or characteristics to those goods that is attributable to that geographical origin. Well-known examples include Parmesan cheese, Sabah tea, Sarawak pepper, Darjeeling tea and Scotch whiskey. The 2022 Act replaces the former Geographical Indications Act 2000 and offers a wider scope of protection for geographical indication (GI) proprietors and greater clarity of the examination process.  

Under the 2022 Act, any person who carries on an activity as a producer in the geographical area with respect to the goods (which includes an association of such persons) or a ‘competent authority’ can apply for GI registration. A ‘competent authority’ includes the government of Malaysia or of a State or any statutory body carrying out functions of, on behalf of, or sanctioned by the same, any other foreign governments, and any authority competent to certify the goods in question.

A GI registration is valid for ten years from the date of registration and is renewable for further periods of ten years each. A separate registration application must be sought for any variant of a GI.

Our trademark practice has naturally expanded into geographical indication (GI) protection and we handle all matters relating to GI protection, including pre-filing search and advice, filing, prosecution, opposition, renewal, maintenance, advice on exploitation and enforcement. As at end of 2023, our firm proudly manages four out of the only fourteen foreign GIs that have been successfully registered in Malaysia.
