Product Registration
Under Malaysia’s Control of Drugs and Cosmetics Regulations 1984 (“the Regulations”), it is mandatory to obtain approval (in the form of product registration) for any drugs or pharmaceutical products, traditional medicines and veterinary products before they can be manufactured, supplied, sold or imported into Malaysia (unless specifically exempted by the Regulations). Such products must be registered with the National Pharmaceutical Regulatory Agency (“NPRA”) (formerly known as National Pharmaceutical Control Bureau).
A registered product is one that has been approved by the Drug Control Authority (DCA) for sale/use in Malaysia, after being evaluated and tested for efficacy and safety. Every registered product is given a registration number (starting with MAL) which must be printed on its label or package.
A Product Registration Holder (PRH) must be a locally incorporated company, corporate or legal entity, with permanent address and registered with Companies Commission of Malaysia (with the scope of business related to the health/pharmaceutical products). As such, a foreign company will have to appoint a Market Authorization Holder (MAH) as their local representative to obtain product registration. The PRH will then be responsible for all matters relating to product quality, safety and efficacy.
A different procedure applies to cosmetics. Since 01 January 2008, the online registration procedure for cosmetic products was replaced with the online notification procedure. Under the Regulations, the NPRA must be notified about cosmetic products before they can be manufactured, sold, supplied or imported into Malaysia. A cosmetic product introduced into the market must not cause damage to human health when applied under normal or reasonably foreseeable conditions of use. Notified cosmetic products must meet all stipulated regulations and guidelines for cosmetic products.
