With the enactment of the latest Trademarks Act in December 2019 (“the Act”) in Malaysia, entities are now able to rely on new provisions such as registering non-traditional marks e.g. color, scent, sound, hologram, positioning, sequence of motion, or any combination of these. Multi-class applications are also now possible under the new Act, among many other positive changes. MyIPO’s compliance to the Madrid Protocol also ensures a swift turnaround time for examinations of International Applications/Registrations designating Malaysia. The Act and Malaysia’s accession to the Madrid Protocol have opened up new possibilities for trademark filing and registration in Malaysia.
